Гэты твор знаходзіцца ў грамадскім набытку паводле Закона Рэспублікі Беларусь № 262-З ад 17 мая 2011 года "Аб аўтарскім праве і сумежным правах" са змяненнямі і дапаўненнямі № 216-З ад 15 ліпеня 2019 года., бо тэрмін аховы аўтарскіх правоў на яго скончыўся або такая ахова ніколі не давалася.
Артыкул 20. Тэрмін дзеяння аўтарскага права.
1. Асабістыя немаёмасныя правы на творы навукі, літаратуры і мастацтва ахоўваюцца бестэрмінова.
2. Выключнае права на твор дзейнічае на працягу жыцця аўтара і 50 гадоў пасля яго смерці, за выключэннем выпадкаў, прадугледжаных гэтым артыкулам.
3. Выключнае права на ананімны твор або твор, выкарыстаны пад псеўданімам, дзейнічае на працягу 50 гадоў з моманту яго стварэння, калі на працягу 50 гадоў з моманту яго стварэння ён не быў правамерна абнародаваны са згоды аўтара.
Пры вызначэнні тэрміна дзеяння выключнага права на ананімны твор або твор, выкарыстаны пад пад псеўданімам, датычна якіх у межах тэрміна, прадугледжанага часткай першай гэтага пункта, аўтар раскрыў свае сапраўднае імя або яго імя перастала быць сумнеўным, ужываецца пункт 2 гэтага артыкула.
4. Выключнае права на твор, створаны ў сааўтарстве, дзейнічае на працягу жыцця і 50 гадоў пасля смерці аўтара, які перажыў іншых сааўтараў.
5. Вылічэнне тэрмінаў, прадугледжаных гэтым артыкулам, пачынаецца з 1 студзеня года, наступнага за годам, у якім меў месца юрыдычны факт, які з'яўляецца падставай для пачатку вылічэння тэрміна.
Артыкул 21. Пераход твораў у грамадскі набытак.
1. Заканчэнне тэрміну дзеяння выключнага права на твор азначае пераход гэтага твора ў грамадскі набытак.
Творы, якім на тэрыторыі Рэспублікі Беларусь ахова ніколі не прадастаўлялася, таксама лічацца тымі, што перайшлі ў грамадскі набытак.
2. Творы, якія перайшлі ў грамадскі набытак, могуць свабодна выкарыстоўвацца любой фізічнай або юрыдычнай асобай без выплаты ўзнагароджання. Пры гэтым павінна выконвацца права аўтарства, права на імя і права на недатыкальнасць твора.
